Intune managing supervised Ipads, refuse to update error 0x87d13c28

Ipads registered in apple school manager and set to intune as MDM. Ipads enrolled into intune using a supervised profile. Ipads assigned into a group in intune. Configuration profiles and app installation profiles created and assigned to the group. Update policy set to "update to latest" and "update at next check in"

Apps install ok, configuration profiles configure ok but the update policy will not work. Error is 0x87d13c28 (also shown as -2016330712)

devices (in intune) show that supervised is yes, shared ipad is no, ownership is corporate, jailbroken is false, encrypted is yes, 17gb of free space.

I have tried creating a fresh enrollment profile and wiping to no effect. I have also tried this with a shared ipad and non shared ipad profile. We do not use user affinity.
