Based as I know, when you add the "Add device to retire list" action to a compliance policy in Intune, the action will not add existing non-compliant devices to the retire list right away. Instead, it will wait for the number of days specified in the Action for noncompliance to trigger the action on the users' devices. Only then will non-compliant devices be added to the retire list.
For example, if you set the Action for noncompliance to 15 days and implement it, devices that are already non-compliant for 15 days will be immediately marked as non-compliant, but they will not be added to the retire list until 15 days have passed. This is because the retire list action is triggered by the Action for noncompliance schedule.
